The use of lead-based paint was banned in 1978. No federal law requires that homeowners test for the presence of lead-based paint.
However, under the Lead-Based Paint Hazard Reduction Act, persons selling or leasing residential housing constructed before 1978 must disclose the presence of known lead-based paint and provide purchasers or lessees with any relevant records or reports. A lead hazard pamphlet must be distributed to all buyers and tenants, and a lead-based paint disclosure statement must be attached to all sales contracts and leases regarding residential properties built before.
